Gimalon AG, the developer of CROWD, (“Gimalon,” „CROWD,“ “we,” “us” or other similar pronouns) respects and values the privacy of its users (“you”) and has developed this Privacy Policy to demonstrate its commitment to protecting your privacy. This Privacy Policy describes the information we collect, how that information may be used, with whom it may be shared, and your choices about such uses and disclosures. We encourage you to read this Privacy Policy carefully when using our application or services or transacting business with us. By using our website or application (our “Service”), you are accepting the practices described in this Privacy Policy.

1 Collection and Use of Information

Information we collect about you

We may collect information that can identify you such as your name, email address, and phone number (“personal information”) and other information that does not identify you. We may collect this information through a website or a mobile application. By using the Service, you are authorizing us to gather, parse and retain data related to the provision of the Service. When you provide personal information through our Service, the information may be sent to servers located in countries around the world.

Information you provide

  • To register as a user with CROWD, you will be asked to sign in using your mobile phone number. Your phone number will be used for identification purposes and is linked to your CROWD User ID.
  • You will also be asked to provide access to your mobile device’s address book. A copy of the phone numbers and names in your address book will be stored on our servers and will only be used to:
    • (a) notify you when your contacts become active on CROWD,
    • (b) indicate which of your contacts is already a CROWD user,
    • (c) correctly display the name of each contact as it appears in your address book when a message is received. (Push Notifications)
  • We will not collect and/or store any other information connected to the phone numbers and names stored in your mobile phone’s address book, such as emails, notes or any other personal information.
  • Since CROWD users may add your phone number to their address book and see that you registered with CROWD, we do not consider the fact that your phone number exists on CROWD as private information.
  • You will also be asked to provide us with your name and a photo. Entering your name and/or uploading a photo are not mandatory steps during the registration process. Should you provide your name and/or photo, it will be visible to other CROWD users as long as:
    • (i) Your mobile phone number is stored in the user’s address book,
    • (ii) or you and the user participate in the same group („Crowd“).
  • You will also be asked to allow CROWD to collect your location information from your device when you download or use the Service. Your location information may be attached to a message and processed and stored like other messages when you share your location information with other users.
  • Additionally, we may process, store, and link your location information to your in-app behavior, to improve our suggestion and recommendation services. This will help CROWD to improve your user experience by suggesting relevant activities, locations, dates, and friends. To retrieve details about nearby points of interest, we may also submit raw location information data to third-party data providers like Google Places.
  • If you exchange messages with other CROWD users, you provide us the content of your chats, and if you contact us with a customer service or other inquiry, you provide us with the content of that communication. Messages shared within a group („Crowd“) are only visible to members of that group. However, new CROWD users can be added to a group at any time by a CROWD user who’s  already a part of that group. Users that are added to a group in such a way at a later point in time will be able to see all previous messages sent by you or other users within this group. Messages may contain text or other media data (photos, videos, audio) that you created, but messages may also be generated automatically on your behalf for specific events (you created a group, you voted, you joined or left a group, you modified the group, etc.).
  • We maintain copies of all messages on our servers. This allows you to access all messages from multiple mobile devices as well as moving your account seamlessly to a new mobile device. The content of these messages and their associated meta information (such as time stamps, location, message length, file size, sender, and recipient, etc.) may be analyzed and/or interpreted by our algorithms in order to better understand network behaviors and trends, detect potential outages and technical issues, and for public safety reasons.
  • CROWD allows the announcements of the creation of a group and/or your participation in a group to other users. The creator of a group and participants have full control over whether this announcement should happen for a group and if so what information about the group is shared (group name, participants, activities, locations, dates, and messages). This setting is a property of individual groups and therefore such announcements may occur whenever you join such a group.
  • CROWD may allow other users to see your connection status (whether you are online or not – and if not when was the last time you were connected to the Service) as well as whether you saw messages they sent to you. We may automatically activate this feature. However, you may disable this via the settings.
  • CROWD may allow you to link your CROWD Account to your personal calendar (device calendar). Linking a calendar allows you to automatically add CROWD events to your calendar for your convenience. CROWD may also analyze and/or interpret the entries in your calendar to improve our suggestions and recommendation services of times and dates. CROWD may use your availability information in an anonymized fashion to improve time suggestions presented to other users connected to you. Other CROWD users can not view your calendar. You may disable this feature in the app settings.
  • In addition, CROWD may collect, store, analyze and/or interpret information about the people and groups you are connected to and how you interact with them, such as the people you communicate with the most. We also collect the information of which activities or locations you participate in or vote for. CROWD uses this information to improve the suggestions and recommendations of friends, activities, events and locations for you. We do not share this information with a third-party.

Use of technologies to collect information

We use various technologies to collect information from your device and about your activities on our Service.

  • Our servers may automatically collect data about your Internet address when you use our services. This information, known as an Internet Protocol address, or IP Address, is a number that is automatically assigned to your computer by your Internet service provider whenever you are on the Internet. Our servers may log your IP Address and, if applicable, your domain name. Your IP Address is used to help identify you and to gather demographic information about our members and users as a whole but does not include personally identifiable information. Our server may also record the referring page that linked you to us (e.g., another website or a search engine); the pages you visit on this Site; the website you visit after this Site; the ads you see and/or click on; other information about the type of Web browser, computer, platform, related software and settings you are using; any search terms you have entered on this Site or a referral site; and other Web usage activity and data logged by our servers. We use this information for internal system administration, to help diagnose problems with our servers, and to administer our Service. Such information may also be used to gather demographic information, such as country of origin and Internet Service Provider.
    Any or all of these activities with regard to site usage information may be performed on our behalf by our service providers, including, for example, our analytics vendor(s) and our e-mail management partner(s) and server hosting partner(s).
  • When you visit our Service, we may assign your device one or more cookies to facilitate access to our Service and to personalize your experience. Through the use of a cookie, we also may automatically collect information about your activity on our Services, such as the pages you visit, the time and date of your visits and the links you click. If we advertise, we (or third parties) may use certain data collected on our Service to show you CROWD advertisements on other sites or applications.
  • We embed pixel tags (also called web beacons or clear GIFs) on web pages, ads, and emails. These tiny, invisible graphics are used to access cookies and track user activities (such as how many times a page has been viewed). We use pixel tags to measure the popularity of our features and services. Ad companies also use pixel tags to measure the number of ads displayed and their performance (such as how many people clicked on an ad).
  • If you are using our app, we use mobile device IDs (the unique identifier assigned to a device by the manufacturer), or Advertising IDs (for iOS 6 and later), instead of cookies, to recognize you. We do this to store your preferences and track your use of our app. Unlike cookies, device IDs cannot be deleted, but Advertising IDs can be reset in „Settings“ on your iPhone. Ad companies also use device IDs or Advertising IDs to track your use of the app, track the number of ads displayed, measure ad performance and display ads that are more relevant to you. Analytics companies use device IDs to track information about app usage.

How we use the information we collect

We may use information that we collect about you to:

  • deliver and improve our products and services, and manage our business;
  • manage your account and provide you with customer support;
  • perform research and analysis about your use of, or interest in, our or others’ products, services, or content;
  • communicate with you by email, postal mail, telephone and/or mobile devices;
  • develop, display, and track content and advertising tailored to your interests on our Service and other sites, including providing our advertisements to you then you visit other sites;
  • website or mobile application analytics;
  • verify your eligibility and deliver prizes in connection with contests and sweepstakes;
  • enforce or exercise any rights in our Terms of Use;
  • perform functions or services as otherwise described to you at the time of collection.

If your personal information is submitted through our website when applying for a position with our company, the information will be used solely in connection with considering and acting upon your application. We may retain your personal information, but only for the purpose of considering your application for current or future available positions.

In all circumstances, we may perform these functions directly or use a third party vendor to perform these functions on our behalf which will be obligated to use your personal information only to perform services for us. Also, if you access our Service from a third-party social platform, such as Facebook, we may share non-personal information with that platform to the extent permitted by your agreement with it and its privacy settings.

Sharing and Disclosure of Information

We do not rent, sell, or share any information about our users with any third-parties, except as specifically described herein.

We may disclose your Personal Information if we believe such action is necessary to:

(a) comply with the law, or legal process served on us;

(b) protect and defend our rights or property (including the enforcement of our agreements); or

(c) act in urgent circumstances to protect the personal safety of users of our Service or members of the public.
In order to provide you with CROWD products you have requested, CROWD may sometimes, if necessary, share your Personal Information (excluding your address book and related information) and traffic data with trusted partner service providers and/or agents, for example: banking organizations or other providers of payment and analytical services, customer support, or hosting services. CROWD will always require these third parties to take appropriate organizational and technical measures to protect your personal data and traffic data and to observe the relevant legislation. Within the framework of the U.S.-Swiss Safe Harbor Framework, our US third-party providers have committed to warranting a reasonable level of privacy which is similar to the Swiss data privacy laws.

The following is a description of how we may share your Personal Information with trusted third party partners. Should we add additional partners, we will immediately update this description:

  • We use third-party companies to send you an authentication SMS when you register with CROWD. To send you the SMS, we send one of these third party companies your phone number and the authentication message. These third parties are contractually obligated to only use your phone number for the transmission of the authentication SMS.
  • If we fail to send you an SMS (this happens in certain cases), you may receive an automated call and will be read the authentication code on the phone. This is done using a third party automated phone system. To call you, we provide this third party partner with your phone number and send the “audio content” of the call to them. The third party partner, in turn, will typically use another phone provider who may use another phone provider and so on until the call reaches you. This is an industry standard mechanism for the transmission of phone calls. The third party partner is contractually obligated to only use your phone number for the completion of the authentication phone call.
  • We may use Push Notification Services to notify you about various events related to the app. If we do, the phone number or the name of the person calling you or sending you a message may be part of the notification. This message is sent to the push notification service provider, for delivery to your device.
  • We use third parties to provide you with information about locations and their descriptions as well as for displaying an interactive map.  We may share anonymized location information with such a third party provider.

Notwithstanding any of the foregoing, the CROWD servers that are used to store your Personal Information are owned and hosted by Google Inc.

We may from time to time ask you to provide information about your experiences, which will be used to measure and improve quality. You are at no time under any obligation to provide any of such data. Any and all information which is voluntarily submitted in feedback forms on our Service or any survey that you accept to take part in is used to review this feedback and improving the CROWD software, products, and websites. We may contact you to send you messages about faults and service issues. Furthermore, we reserve the right to use email, the CROWD software or SMS to notify you of any eventual claims related to your use of our software, websites and/or products, including without limitation claims of violation of third party rights. We may send you alerts via the CROWD software to notify you when someone has tried to contact you. We may also use the CROWD software to keep you up to date with news about our software and products that you have purchased and/or to inform you about other CROWD products and related information.

We collect and analyze user information by sharing user data with the following services:

  • Log Data
    Like many site operators, we collect information that your browser sends whenever you visit our Site (“Log Data”).   • Google Analytics
    We use “Google Analytics” to collect information about the use of this site.   • Google AdWords
    We use the Google AdWords remarketing service to advertise on third party websites (including Google) to previous visitors to our site. It could mean that we advertise to previous visitors who have not completed a task on our site, for example downloading the CROWD mobile app. This could be in the form of an advertisement on the Google search results page, or a site in the Google Display Network. Third-party vendors, including Google, use cookies to serve ads based on someone’s past visits to the site. Any data collected will be used in accordance with our own privacy policy and Google’s privacy policy. You can set preferences for how Google advertises to you using the Google Ad Preferences page, and if you want to you can opt out of interest-based advertising entirely by cookie settings or permanently using a browser plugin.

There are a number of places on our Service where you may click on a link to access other websites that do not operate under this Privacy Policy. How we protect your personal information

We take security measures to help safeguard your personal information from unauthorized access and disclosure. Personal Information is stored on our servers and protected by secured networks to which access is limited to a few authorized employees and personnel.

However, no system can be completely secure. Therefore, although we take steps to secure your information, we do not promise, and you should not expect, that your personal information, chats, or other communications will always remain secure. Users should also take care with how they handle and disclose their personal information and should avoid sending personal information through insecure email.


2 Children’s Privacy

CROWD websites and software clients are not intended for or designed to attract anyone under the age of 13, and we do not intentionally or knowingly collect Personal Information on our sites from anyone under the age of 13 (or older in some jurisdictions). We encourage parents to be involved in the online activities of their children to ensure that no information is collected from a child without parental permission.


3 Business Transitions

In the event that we go through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of our assets, Personal Information will likely be among the assets transferred. As part of such a transaction, the new entity will be required to commit to the same level of protection of your Personal Information as described in this Privacy Policy. If we cannot obtain such a commitment, we will not perform the business transition.
